GENERAL TERMS AND CONDITIONS
(hereinafter: “GTC”)

I. The Webshop
1) The REVAMPDECOR webshop (hereinafter: “Webshop”) is the product catalog available on the website revampdecor.hu (hereinafter: “Website”) operated by Soós-Vári Mária Johanna Sole Entrepreneur (hereinafter: “Service Provider”), offering for sale some or all of the home decor items (hereinafter: “Product”) distributed by the Service Provider. By placing an electronic order on the Webshop and its acceptance by the Service Provider, a sales contract is concluded between the individual or legal entity placing the order (hereinafter: “Buyer”) and the Service Provider. The sales contract is concluded for a definite period until its fulfillment. Orders can only be placed electronically; orders placed by phone, fax, email, or mail are not accepted by the Service Provider.

2) The sales contract concluded in this manner is established in Hungarian and qualifies as a written contract, which is recorded, filed under an order number, and stored by the Service Provider for 5 years from the last day of the calendar year following its registration. (Hungarian Civil Code, Section 6:82 (1)).

3) This GTC shall apply to the individual sales contracts falling under its scope and shall form an integral part of them unless otherwise expressly provided. Before concluding the sales contract, the Buyer has read and accepted the content of this GTC by ticking the empty checkbox, and accordingly, it fully governs the legal relationship between the Buyer and the Service Provider.

4) This GTC is accessible at any time to anyone on the Service Provider’s Website.

II. The Product
6) Products can be ordered with home delivery or personal pickup. Personal pickup location: 2234 Maglód, Csokonai u 7. The Product is a home decor item made from recycled materials. The indicated price of the Product is gross. The Product price does not include delivery costs, which can be found on the checkout summary page.
In addition to the data provided in the description, the Buyer may request further information from the Service Provider by email or phone.

The Service Provider offers delivery not only within Hungary but also to member states of the European Union. The delivery fees, methods, and estimated delivery times for each country are indicated on the Webshop’s checkout page and under the “Shipping Information” menu. When entering a foreign shipping address, the system automatically calculates the delivery fee applicable to the respective country.

III. Complaints and Liability
8) If the Buyer has any complaints related to the sales contract or its performance, they may communicate them to the Service Provider via the contact details and methods specified in point 5 of this GTC. The Service Provider shall investigate the received complaint within 15 days of receipt and inform the Buyer of the result of the investigation or, in the case of rejection, the available legal remedies using the same method the complaint was received. In case of rejection of the complaint, the Buyer has the right to turn to the Conciliation Board competent according to their place of residence or habitual residence. However, initiating the procedure of the Conciliation Board requires the consumer to attempt to settle the disputed matter directly with the concerned business. In the absence of the consumer’s domestic place of residence or habitual residence, the Conciliation Board competent at the Service Provider’s registered office has jurisdiction, which is the Budapest Conciliation Board (address: 1016 Budapest, Krisztina krt. 99., phone number: +36 1 4882131, mailing address: 1253 Budapest, P.O. Box 10, email: [email protected]).

Consumers residing within the European Union are entitled to use the European Commission’s online dispute resolution platform, available at the following link:

The operator of the Webshop accepts dispute resolution requests submitted through this platform.

9) The Service Provider’s liability for warranty and guarantee is governed by the provisions of the Hungarian Civil Code and Government Decree 19/2014 (IV. 29.) NGM.

 

IV. Browsing and Purchasing in the Webshop
10) Browsing

The Webshop provides an opportunity for product presentation and online ordering. Anyone can browse the Webshop without registration. From the product list, the detailed product page can be accessed by clicking on the Product name, where detailed characteristics and prices of the desired Product can be found.
Selecting the Product

11) The selected Product can be placed into the cart using the cart button. The Buyer can check the cart contents via the “Cart” menu. Here the contents of the Cart, including individual items, can be modified and/or deleted. The entire cart can be emptied with the “Empty Cart” button. After placing the desired Products into the Cart, the Buyer can proceed by clicking the “Order” button.

12) Registration and Login

The Buyer can purchase the Product without registration. For purchases without registration, the Buyer must provide the following data: email address, name, phone number, billing address, and—if different—the shipping address. The Buyer is responsible for updating their data and must notify the Service Provider if they become aware of any misuse of their data by a third party.

13) Selecting the Payment and Delivery Method
After selecting the Product, the Buyer chooses a preferred payment method. Using a summary page, the Buyer can review all provided data and the Products to be ordered, including their price and quantity. In case of data entry errors, corrections can be made using the pencil icon. If the Buyer finds everything in order, they can finalize and send the order by clicking the “Submit Order” button. Sending the order by the Buyer constitutes an offer. The Buyer will receive an automatic confirmation via email within 1 working day, indicating the order number. The invoice will be issued by the next working day at the latest. If the automatic confirmation does not arrive within this period, the Buyer shall be released from the obligation of the offer. If the Buyer notices incorrect data after sending the order (e.g., in the confirmation email), they must notify the Service Provider immediately but no later than within 24 hours. Logging into the Webshop is not required to view prices or place Products into the Cart.

14) The ordered Product will be delivered in Hungary outside Budapest by Magyar Posta to the shipping address provided by the Buyer or by the Service Provider within Budapest. Personal pickup is available at 2234 Maglód at a prearranged time.

Reporting delivery issues
Loss, partial loss, damage, or destruction of the postal shipment must be reported immediately upon delivery by noting it on the delivery document. Failure to do so will result in loss of rights. In the absence of a delivery document, any damage must be reported to the postal service within 3 days from the delivery date using another document referring to the shipment.

Delivery deadline
For in-stock products, delivery takes place within 3 business days from the order confirmation. If the 3-day delivery is not possible, the Service Provider must inform the Buyer within 24 hours of the order.

15) If the ordered product is unavailable or cannot be delivered within 10 business days, the Service Provider shall inform the Buyer immediately and refund any prepaid amount via bank transfer or card within a maximum of 15 days.

V. Withdrawal

16) Right of Withdrawal of the Buyer
The Buyer has the right to withdraw from the sales contract within 14 days from the date of receipt of the ordered Product, without providing any reason. The Buyer may exercise the right of withdrawal by completing the sample form attached as Annex 1 to this GTC or by submitting a clear written declaration expressing the intention to withdraw (hereinafter collectively: “Withdrawal Statement”), and sending one of them to the Service Provider. The Buyer must send the Withdrawal Statement either by postal mail to the Service Provider’s registered address specified in point 5, or electronically via email. The right of withdrawal is considered exercised in due time if the Buyer sends the Withdrawal Statement before the 14-day deadline expires.

The right of withdrawal also applies to natural person consumers residing in any member state of the European Union. EU customers are likewise entitled to withdraw from the purchase within 14 days of receipt, without providing any reason. The procedure and consequences of withdrawal are the same as outlined in these General Terms and Conditions.

If the Buyer has ordered multiple Products and the delivery of those Products takes place at different times, the withdrawal period shall be calculated from the day of delivery of the last Product. The Buyer may only exercise the right of withdrawal if the Product is returned in undamaged condition and in its original packaging, due to the handmade nature of the Product.

The Buyer may also withdraw from the contract between the date of conclusion and the date of receipt of the Product.

17) Legal Consequences of Exercising the Right of Withdrawal
In case of withdrawal, the Service Provider shall refund all payments received from the Buyer, including delivery costs, without undue delay, but no later than 14 days from the date the Withdrawal Statement is received. This does not include any additional costs incurred if the Buyer chose a delivery method other than the least expensive standard delivery method offered by the Service Provider.

The Service Provider may withhold the refund until the Product has been returned by the Buyer or the Buyer has provided credible proof of having returned the Product, whichever occurs first. The Service Provider is not entitled to withhold the refund if it has undertaken to collect the returned Product.

The refund shall be made using the same payment method used by the Buyer, unless the Buyer has explicitly agreed to a different method. The Buyer shall not bear any extra cost for choosing a different refund method.

18) Obligations of the Buyer in Case of Withdrawal
The Buyer shall return or hand over the Product affected by the withdrawal to the Service Provider’s registered address (as provided in point 5) without undue delay, but no later than 14 days from the date of the Withdrawal Statement. The return is deemed timely if the Product is posted or handed over before the deadline expires. The cost of return shall be borne by the Buyer.

The Buyer is liable for any diminished value of the returned Product if it results from handling beyond what is necessary to establish the nature, characteristics, and functioning of the Product.

19) Return Address, Cost and Method
In case of withdrawal, the Buyer shall return the Product at their own expense to the following address:

Return is only possible after prior arrangement. Personal return can only be made at a previously agreed time, which must be arranged with the Service Provider via email at [email protected] or phone at +36 30 592 2021.

The cost of returning the Product is always borne by the Buyer unless the return is due to the fault of the Service Provider (e.g. defective, damaged, or incorrect item). In such cases, the method and cost of return shall be agreed upon between the Service Provider and the Buyer.

The Service Provider does not accept parcels sent with cash-on-delivery. The Buyer will be notified via email upon receipt and condition assessment of the returned Product.

20) Exceptions to the Right of Withdrawal
The Buyer is not entitled to withdraw from the contract if they have caused any damage to the Product in any way. The Buyer acknowledges that in such cases, the right of withdrawal is forfeited based on Section 29 (1) e) of the Government Decree.

Furthermore, the right of withdrawal does not apply to:

  • Products that are not prefabricated, made based on the consumer’s individual request or instructions, or clearly tailored to the consumer’s personal needs.

  • Products for which the operator performs urgent repair or maintenance work at the express request of the consumer.

 

VI. Other Provisions

21) For matters not regulated in this GTC or in the individual sales contract, the provisions of Act V of 2013 on the Civil Code of Hungary, Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Services Related to the Information Society, and Government Decree 45/2014 (II.26.) on the Detailed Rules of Contracts Between Consumers and Businesses shall apply.

22) This GTC is effective from July 1, 2022.
The Service Provider is entitled to unilaterally amend the GTC. Any amendments shall be published by the Service Provider on the Website at least 11 (eleven) days before they come into effect.

23) This GTC remains in effect until revoked or replaced by a new version.

24) The Service Provider reserves all rights regarding the distribution of the Webshop, its components, and the content appearing on it. It is forbidden to download, electronically store, process, or resell the content or any part thereof appearing in the Webshop without the written permission of the Service Provider.

25) The Service Provider’s data processing activities related to the Webshop are governed by Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation – GDPR), on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. Detailed information on the Service Provider’s data processing activities related to the Webshop is available in the “Privacy Policy” document of the Webshop.

26) The language of the contracts concluded through the Webshop is Hungarian. The English version of the Webshop is provided for informational purposes only. These General Terms and Conditions and the contractual relationship between the parties shall be governed by Hungarian law. Mandatory consumer protection provisions of the consumer’s country of residence may not be derogated from.
